ধারা ৬- বিলিং এবং অ্যাকাউন্টের তথ্যের যথার্থতাঃ

আমরা আপনার যে কোনো অর্ডার প্রত্যাখ্যান করার অধিকার আমরা সংরক্ষণ করি। আমরা, আমাদের নিজস্ব বিবেচনার ভিত্তিতে, প্রতি ব্যক্তি, পরিবার বা অর্ডার প্রতি ক্রয়কৃত পরিমাণ সীমিত বা বাতিল করতে পারি। এই বিধিনিষেধগুলির মধ্যে একই গ্রাহক অ্যাকাউন্ট, একই ক্রেডিট কার্ড অথবা একই বিলিং অথবা শিপিং ঠিকানা ব্যবহার করে এমন অর্ডারগুলি অন্তর্ভুক্ত থাকতে পারে। ইভেন্টে যে আমরা একটি অর্ডার পরিবর্তন বা বাতিল করি, আমরা অর্ডার করার সময় প্রদত্ত ই-মেইল অথবা বিলিং ঠিকানা/ফোন নম্বরে যোগাযোগ করে আপনাকে অবহিত করার চেষ্টা করতে পারি। আমরা এমন আদেশ সীমিত বা নিষিদ্ধ করার অধিকার সংরক্ষণ করি যা, আমাদের একমাত্র বিচারে, ডিলার, রিসেলার বা পরিবেশকদের দ্বারা স্থাপিত বলে মনে হয়।

আপনি আমাদের ওয়েবসাইটে করা সমস্ত কেনাকাটার জন্য বর্তমান, সম্পূর্ণ এবং সঠিক ক্রয় এবং অ্যাকাউন্ট তথ্য প্রদান করতে সম্মত হন। আপনি অবিলম্বে আপনার ইমেল ঠিকানা এবং ক্রেডিট কার্ড নম্বর এবং মেয়াদ শেষ হওয়ার তারিখ সহ আপনার অ্যাকাউন্ট এবং অন্যান্য তথ্য আপডেট করতে সম্মত হন, যাতে আমরা আপনার লেনদেন সম্পূর্ণ করতে পারি এবং প্রয়োজনে আপনার সাথে যোগাযোগ করতে পারি।

ধারা ৭ - ঐচ্ছিক সরঞ্জামঃ

আমরা আপনাকে তৃতীয় পক্ষের সরঞ্জামগুলিতে অ্যাক্সেস সরবরাহ করতে পারি যার উপর আমাদের নজরদারি বা নিয়ন্ত্রণ বা ইনপুট নেই। আপনি স্বীকার করেন এবং সম্মত হন যে আমরা কোনও ওয়ারেন্টি, উপস্থাপনা বা শর্ত ছাড়াই এবং কোনও অনুমোদন ছাড়াই "যেমন আছে" এবং "যেমন উপলব্ধ" এই জাতীয় সরঞ্জামগুলিতে অ্যাক্সেস সরবরাহ করি। আপনার ঐচ্ছিক তৃতীয় পক্ষের সরঞ্জামগুলির ব্যবহার থেকে উদ্ভূত বা সম্পর্কিত যাই হোক না কেন আমাদের কোন দায়বদ্ধতা থাকবে না।

ধারা ৮ - তৃতীয় পক্ষের লিঙ্কঃ

আমাদের পরিষেবার মাধ্যমে উপলব্ধ কিছু বিষয়বস্তু, পণ্য এবং পরিষেবাগুলিতে তৃতীয় পক্ষের সামগ্রী অন্তর্ভুক্ত থাকতে পারে।

এই সাইটে তৃতীয় পক্ষের লিঙ্কগুলি আপনাকে তৃতীয় পক্ষের ওয়েবসাইটগুলিতে নির্দেশ করতে পারে যেগুলি আমাদের সাথে অনুমোদিত নয়৷ আমরা বিষয়বস্তু বা নির্ভুলতা পরীক্ষা বা মূল্যায়নের জন্য দায়ী নই এবং আমরা কোনো তৃতীয় পক্ষের সামগ্রী, ওয়েবসাইট, তৃতীয় পক্ষের অন্য কোনো উপকরণ, পণ্য বা পরিষেবার জন্য কোনো দায়বদ্ধতা প্রদান করি না।

আমরা ক্রয় বা পণ্য, পরিষেবা, সম্পদ, বিষয়বস্তু, বা কোনো তৃতীয় পক্ষের ওয়েবসাইটের সাথে সম্পর্কিত অন্য কোনো লেনদেনের ব্যবহার সম্পর্কিত কোনো ক্ষতি বা ক্ষতির জন্য দায়ী নই। দয়া করে তৃতীয় পক্ষের নীতি এবং অনুশীলনগুলি সাবধানে পর্যালোচনা করুন এবং নিশ্চিত করুন যে আপনি কোনও লেনদেনে জড়িত হওয়ার আগে সেগুলি বুঝতে পেরেছেন৷ তৃতীয় পক্ষের পণ্য সম্পর্কিত অভিযোগ, দাবি, উদ্বেগ বা প্রশ্ন তৃতীয় পক্ষের কাছে পাঠানো উচিত।

 

ধারা ৯- ব্যবহারকারীর মন্তব্য, প্রতিক্রিয়া এবং অন্যান্য জমাঃ

যদি, আমাদের অনুরোধে, আপনি নির্দিষ্ট কিছু জমা পাঠান (উদাহরণস্বরূপ প্রতিযোগিতার এন্ট্রি) অথবা আমাদের অনুরোধ ছাড়াই আপনি সৃজনশীল ধারণা, পরামর্শ, প্রস্তাব, পরিকল্পনা বা অন্যান্য উপকরণ পাঠান, তা অনলাইনে হোক, ইমেলের মাধ্যমে, ডাকযোগে বা অন্যথায়। (সম্মিলিতভাবে, 'মন্তব্য'), আপনি সম্মত হন যে আমরা যে কোনো সময়ে, সীমাবদ্ধতা ছাড়াই, আপনি আমাদের কাছে ফরোয়ার্ড করা যেকোনো মন্তব্য সম্পাদনা, অনুলিপি, প্রকাশ, বিতরণ, অনুবাদ এবং অন্য কোনো মাধ্যমে ব্যবহার করতে পারি। আমরা কোন বাধ্যবাধকতার অধীনে আছি এবং থাকব না (ক) আত্মবিশ্বাসের সাথে কোন মন্তব্য বজায় রাখতে; (খ) কোনো মন্তব্যের জন্য ক্ষতিপূরণ দিতে; অথবা (গ) কোনো মন্তব্যের জবাব দিতে।

আমাদের নিজস্ব বিবেচনার ভিত্তিতে যে বিষয়বস্তু বেআইনি, আপত্তিকর, হুমকি, মানহানিকর,  পর্নোগ্রাফিক, অশ্লীল বা অন্যথায় আপত্তিকর বা কোনো পক্ষের মেধা সম্পত্তি বা এই পরিষেবার শর্তাদি লঙ্ঘন করে এমন বিষয়বস্তু নিরীক্ষণ, সম্পাদনা বা অপসারণ করতে আমাদের কোনো বাধ্যবাধকতা নেই।

আপনি সম্মত হন যে আপনার মন্তব্য কপিরাইট, ট্রেডমার্ক, গোপনীয়তা, ব্যক্তিত্ব বা অন্যান্য ব্যক্তিগত বা মালিকানা অধিকার সহ কোন তৃতীয় পক্ষের কোন অধিকার লঙ্ঘন করবে না। আপনি আরও সম্মত হন যে আপনার মন্তব্যে মানহানিকর বা অন্যথায় বেআইনি, আপত্তিজনক বা অশ্লীল উপাদান থাকবে না, বা কোনও কম্পিউটার ভাইরাস বা অন্যান্য ম্যালওয়্যার থাকবে না যা পরিষেবা বা কোনও সম্পর্কিত ওয়েবসাইটের ক্রিয়াকলাপকে কোনওভাবে প্রভাবিত করতে পারে। আপনি একটি মিথ্যা ই-মেইল ঠিকানা ব্যবহার করতে পারবেন না, নিজেকে ছাড়া অন্য কেউ হওয়ার দাবি করতে পারবেন না, বা অন্যথায় আমাদের বা তৃতীয় পক্ষকে কোনো মন্তব্যের উৎস সম্পর্কে বিভ্রান্ত করতে পারবেন না। আপনি যে কোনো মন্তব্য এবং তাদের নির্ভুলতার জন্য সম্পূর্ণরূপে দায়ী। আমরা  আপনার বা কোন তৃতীয় পক্ষের দ্বারা পোস্ট করা কোন মন্তব্যের জন্য কোন দায়বদ্ধতা গ্রহণ করি না।

 

ধারা ১০ - ব্যক্তিগত তথ্যঃ

ওয়েবসাইটের মাধ্যমে আপনার ব্যক্তিগত তথ্য জমা দেওয়া আমাদের গোপনীয়তা নীতি দ্বারা পরিচালিত হয়।

 

ধারা ১১ - ত্রুটি, ভুল এবং বাদ দেওয়াঃ

মাঝে মাঝে আমাদের সাইটে বা পরিষেবাতে এমন তথ্য থাকতে পারে যাতে টাইপোগ্রাফিক ত্রুটি, ভুল বা বাদ দেওয়া হয় যা পণ্যের বিবরণ, মূল্য, প্রচার, অফার, পণ্য শিপিং চার্জ, ট্রানজিট সময় এবং প্রাপ্যতার সাথে সম্পর্কিত হতে পারে। আমরা যেকোন ত্রুটি, ভুল বা ভুল সংশোধন করার অধিকার সংরক্ষণ করি এবং তথ্য পরিবর্তন , আপডেট বা অর্ডার বাতিল করার অধিকার রাখি যদি পরিষেবাতে বা সম্পর্কিত যেকোন ওয়েবসাইটে কোনো তথ্য পূর্ব ঘোষণা ছাড়াই যেকোন সময় ভুল হয় (আপনি আপনার অর্ডার  দেওয়ার পরেও) ।

আমরা পরিষেবাতে বা কোনও সম্পর্কিত ওয়েবসাইটে তথ্য আপডেট, সংশোধন বা স্পষ্ট করার কোনো বাধ্যবাধকতা গ্রহণ করি না, যার মধ্যে আইনের প্রয়োজন ছাড়া সীমাবদ্ধতা ছাড়াই, মূল্যের তথ্য সহ। পরিষেবায় বা কোনও সম্পর্কিত ওয়েবসাইটে প্রয়োগ করা কোনও নির্দিষ্ট আপডেট বা রিফ্রেশ তারিখ, পরিষেবা বা কোনও সম্পর্কিত ওয়েবসাইটের সমস্ত তথ্য সংশোধন বা আপডেট করা হয়েছে তা নির্দেশ করার জন্য নেওয়া উচিত।

 

ধারা ১২ - নিষিদ্ধ ব্যবহারঃ

পরিষেবার শর্তাবলীতে উল্লিখিত অন্যান্য নিষেধাজ্ঞাগুলি ছাড়াও, আপনি সাইট বা এর বিষয়বস্তু ব্যবহার করা নিষিদ্ধ: (ক) কোনো বেআইনি উদ্দেশ্যে; (খ) অন্যদেরকে কোনো বেআইনি কাজ সম্পাদন বা অংশগ্রহণের জন্য অনুরোধ করা; (গ) কোনো আন্তর্জাতিক, ফেডারেল, প্রাদেশিক বা রাষ্ট্রীয় প্রবিধান, নিয়ম, আইন বা স্থানীয় অধ্যাদেশ লঙ্ঘন করা; (ঘ) আমাদের মেধা সম্পত্তি অধিকার বা অন্যের মেধা সম্পত্তি অধিকার লঙ্ঘন করা; (ঙ) লিঙ্গ, যৌন অভিযোজন, ধর্ম, জাতিসত্তা, জাতি, বয়স, জাতীয় , অক্ষমতার ভিত্তিতে হয়রানি, অপমান, অপমান, ক্ষতি, মানহানি, অপবাদ, অপমান, ভীতি প্রদর্শন বা বৈষম্য করা; (চ) মিথ্যা বা বিভ্রান্তিকর তথ্য দাখিল করা; (ছ) আপলোড বা সংক্রমণ বা ভাইরাস বা অন্য কোনো ধরনের দূষিত কোড যা পরিষেবার কার্যকারিতা বা কোনো সম্পর্কিত ওয়েবসাইট, অন্যান্য ওয়েবসাইট বা ইন্টারনেটকে প্রভাবিত করবে এমন কোনো উপায়ে ব্যবহার করা যেতে পারে; (জ) অন্যের ব্যক্তিগত তথ্য সংগ্রহ বা ট্র্যাক করা; (i) স্প্যাম, ফিশ, ফার্ম, অজুহাত, মাকড়সা, ক্রল বা স্ক্র্যাপ করা; (j) কোন অশ্লীল বা অনৈতিক উদ্দেশ্যে;  (ট) পরিষেবার নিরাপত্তা বৈশিষ্ট্য বা কোনো সম্পর্কিত ওয়েবসাইট, অন্যান্য ওয়েবসাইট, ইন্টারনেটে হস্তক্ষেপ বা বাধা দেওয়া। আমরা আপনার পরিষেবা বা কোনও সম্পর্কিত ওয়েবসাইট ব্যবহার বন্ধ করার অধিকার সংরক্ষণ করি যে কোনও নিষিদ্ধ ব্যবহার লঙ্ঘনের জন্য।

 

ধারা ১৩ - ওয়্যারেন্টি অস্বীকৃতি; দায়বদ্ধতা সীমাবদ্ধতাঃ

আমরা গ্যারান্টি দিই না, প্রতিনিধিত্ব করি বা ওয়ারেন্টি দিই না যে আমাদের পরিষেবার আপনার ব্যবহার নিরবচ্ছিন্ন, সময়োপযোগী, নিরাপদ বা ত্রুটি-মুক্ত হবে। আমরা নিশ্চিত করি না যে পরিষেবার ব্যবহার থেকে প্রাপ্ত ফলাফলগুলি সঠিক বা নির্ভরযোগ্য হবে। আপনি সম্মত হন যে সময়ে সময়ে আমরা আপনাকে নোটিশ ছাড়াই অনির্দিষ্ট সময়ের জন্য পরিষেবাটি সরিয়ে ফেলতে পারি বা যেকোনো সময় পরিষেবা বাতিল করতে পারি। আপনি স্পষ্টভাবে সম্মত হন যে আপনার ব্যবহার, বা ব্যবহারে অক্ষমতা, পরিষেবাটি আপনার একমাত্র ঝুঁকিতে রয়েছে। পরিষেবা এবং পরিষেবার মাধ্যমে আপনাকে সরবরাহ করা সমস্ত পণ্য এবং পরিষেবাগুলি (আমাদের দ্বারা স্পষ্টভাবে বলা ছাড়া) আপনার ব্যবহারের জন্য 'যেমন আছে' এবং 'যেমন উপলব্ধ' প্রদান করা হয়, কোনো প্রতিনিধিত্ব, ওয়ারেন্টি বা কোনো ধরনের শর্ত ছাড়াই, প্রকাশ , সমস্ত অন্তর্নিহিত ওয়ারেন্টি বা ব্যবসায়িকতার শর্তাবলী, ব্যবসায়িক গুণমান, একটি নির্দিষ্ট উদ্দেশ্যে ফিটনেস, স্থায়িত্ব, শিরোনাম এবং অলঙ্ঘন।

কোনো অবস্থাতেই সুপারবি, আমাদের পরিচালক, কর্মকর্তা, কর্মচারী, সহযোগী, এজেন্ট, ঠিকাদার, ইন্টার্ন, সরবরাহকারী, পরিষেবা প্রদানকারী বা লাইসেন্সদাতারা কোনো আঘাত, ক্ষতি, দাবি বা কোনো প্রত্যক্ষ, পরোক্ষ, আনুষঙ্গিক, শাস্তিমূলক, বিশেষ, বা সীমাবদ্ধতা ছাড়াই লাভ হারানো, হারানো রাজস্ব, হারানো সঞ্চয়, ডেটা হারানো, প্রতিস্থাপনের খরচ বা অনুরূপ কোনো ক্ষতি, চুক্তির ভিত্তিতে হোক না কেন, নির্যাতন (অবহেলা সহ), কঠোর দায়বদ্ধতা বা অন্যথায়, আপনার থেকে উদ্ভূত যেকোনো ধরনের ফলপ্রসূ ক্ষতি। যেকোনও পরিষেবা ব্যবহার করে সংগৃহীত কোনও পণ্যের ব্যবহার, কোনও পণ্যের আপনার ব্যবহারের সাথে সম্পর্কিত অন্য কোনও দাবির জন্য, যে কোনও বিষয়বস্তুতে কোনও ত্রুটি বা বাদ পড়া সহ, তবে সীমাবদ্ধ নয়। পরিষেবার ব্যবহার বা কোনও বিষয়বস্তু (বা পণ্য) পোস্ট করা, প্রেরণ করা বা অন্যভাবে পরিষেবার মাধ্যমে উপলব্ধ করার ফলে যে কোনও ধরণের ক্ষতি এমনকি যদি তাদের সম্ভাবনার পরামর্শ দেওয়া হয়। যেহেতু কিছু রাজ্য বা এখতিয়ারগুলি আনুষঙ্গিক ক্ষতির জন্য দায় বর্জন বা সীমাবদ্ধতার অনুমতি দেয় না, এই জাতীয় এখতিয়ারে, আমাদের দায় আইন দ্বারা অনুমোদিত সর্বাধিক পরিমাণে সীমাবদ্ধ থাকবে৷

 

ধারা ১৪ - ক্ষতিপূরণঃ

আপনি ক্ষতিপূরণ দিতে, রক্ষা করতে এবং ক্ষতিকারক সুপারবি এবং আমাদের পিতামাতা, সহযোগী, সহযোগী, অংশীদার, কর্মকর্তা, পরিচালক, এজেন্ট, ঠিকাদার, লাইসেন্সদাতা, পরিষেবা প্রদানকারী, উপ-কন্ট্রাক্টর, সরবরাহকারী, ইন্টার্ন এবং কর্মচারী, যুক্তিসঙ্গত সহ যেকোনো দাবি বা দাবি থেকে ক্ষতিপূরণ দিতে সম্মত হন। অ্যাটর্নিদের ফি, আপনার এই পরিষেবার শর্তাবলীর লঙ্ঘনের কারণে বা উদ্ভূত যে কোনো তৃতীয়-পক্ষের দ্বারা তৈরি করা হয়েছে বা রেফারেন্সের মাধ্যমে তারা যে নথিগুলি অন্তর্ভুক্ত করেছে, বা কোনো আইন বা তৃতীয় পক্ষের অধিকার আপনার লঙ্ঘন করেছে।

 

 

 

 

ধারা ১৫ – বিভাজনযোগ্যতাঃ

যদি এই পরিষেবার শর্তাবলীর কোনো বিধান বেআইনি, অকার্যকর বা অপ্রয়োগযোগ্য বলে নির্ধারণ করা হয়, তবে এই ধরনের বিধান প্রযোজ্য আইন দ্বারা অনুমোদিত সম্পূর্ণ পরিমাণে প্রয়োগযোগ্য হবে, এবং অপ্রয়োগযোগ্য অংশটিকে এই শর্তাবলী থেকে বিচ্ছিন্ন বলে গণ্য করা হবে । পরিষেবা, এই ধরনের সংকল্প অন্য কোনও অবশিষ্ট বিধানের বৈধতা এবং প্রয়োগযোগ্যতাকে প্রভাবিত করবে না।

 

ধারা ১৬ – সমাপ্তিঃ

সমাপ্তির তারিখের পূর্বে সংঘটিত পক্ষগুলির বাধ্যবাধকতা এবং দায়গুলি সমস্ত উদ্দেশ্যে এই চুক্তির সমাপ্তির পরে বেঁচে থাকবে৷ এই পরিষেবার শর্তাবলী কার্যকর হয় যদি না এবং যতক্ষণ না আপনি বা আমাদের দ্বারা সমাপ্ত হয়। আপনি যেকোন সময় আমাদের এই পরিষেবার শর্তাদি বন্ধ করে দিতে পারেন যে আপনি আমাদের পরিষেবাগুলি আর ব্যবহার করতে চান না, অথবা আপনি যখন আমাদের সাইট ব্যবহার বন্ধ করবেন। যদি আমাদের একমাত্র বিচারে আপনি ব্যর্থ হন, অথবা আমাদের সন্দেহ হয় যে আপনি এই পরিষেবার শর্তাবলীর কোনো শর্ত বা বিধান মেনে চলতে ব্যর্থ হয়েছেন, আমরাও কোনো নোটিশ ছাড়াই এই চুক্তিটি বাতিল করতে পারি এবং আপনি সমস্ত বকেয়া পরিমাণের জন্য দায়বদ্ধ থাকবেন। এবং সমাপ্তির তারিখ অথবা সেই অনুযায়ী আপনাকে আমাদের পরিষেবাগুলিতে অ্যাক্সেস অস্বীকার করতে পারে।

 

ধারা ১৭ - সম্পূর্ণ চুক্তিঃ

এই পরিষেবার শর্তাবলীর কোনো অধিকার বা বিধান প্রয়োগে আমাদের ব্যর্থতা এই ধরনের অধিকার বা বিধানের মওকুফ গঠন করবে না। এই পরিষেবার শর্তাদি এবং এই সাইটে বা পরিষেবার বিষয়ে আমাদের দ্বারা পোস্ট করা কোনও নীতি বা অপারেটিং নিয়মগুলি আপনার এবং আমাদের মধ্যে সম্পূর্ণ চুক্তি এবং বোঝাপড়া গঠন করে এবং আপনার পরিষেবার ব্যবহার পরিচালনা করে, যে কোনও পূর্বের বা সমসাময়িক চুক্তি, যোগাযোগ এবং প্রস্তাবগুলিকে ছাড়িয়ে যায়। মৌখিক বা লিখিত যাই হোক না কেন, আপনার এবং আমাদের মধ্যে ( সীমাবদ্ধ নয়, পরিষেবার শর্তাবলীর কোনো পূর্ববর্তী সংস্করণ)। এই পরিষেবার শর্তাবলীর ব্যাখ্যায় কোনো অস্পষ্টতা খসড়া পক্ষের বিরুদ্ধে বোঝানো হবে না।

 

ধারা ১৮ - গভর্নিং আইনঃ

এই পরিষেবার শর্তাবলী এবং যে কোনও পৃথক চুক্তি যার দ্বারা আমরা আপনাকে পরিষেবাগুলি প্রদান করি তা বাংলাদেশের আইন অনুসারে পরিচালিত হবে এবং বোঝানো হবে৷

 

 

 

 

ধারা ১৯ - পরিষেবার শর্তাবলীতে পরিবর্তনঃ
